The VoiceOut! app (“App”) is owned and operated by Faith in Love Foundation Limited ("Faith in Love", "we", "us", "our"). We are committed to protecting personal data. This privacy policy explains to users of the App how we collect, use, disclose and otherwise process your personal data when you download and use the App or use services accessible through the App (“Services”).

By accessing and using the App, you agree to be bound by this privacy policy. If you choose not to accept the terms and conditions listed below, please do not download or use this App or the Services. This App is provided by Faith in Love at no cost and is intended for use as is.

The Personal Data We Collect About You

We may collect, use, store and transfer different kinds of personal data about you, as follows:

• Identity Data: first name, last name, maiden name, username, race, age, sexual orientation, disability, faith, gender, gender reassignment or similar identifier.
• Contact Data: email address, telephone number and (optional) social media (e.g. Telegram) account.
• Device Data: includes the type of mobile device you use, a unique device identifier (for example, your device’s IMEI number, the MAC address of the device’s wireless network interface, or the mobile phone number used by the device), mobile network information, your mobile operating system, the type of mobile browser you use, and time zone setting.
• Content Data: includes information stored on your device, including login information, photos, videos, or other digital content, content of any incident report you make, correspondence that you have with us, and any other additional information that you provide about instances of discrimination.
• Profile Data: includes your username and password, in-app transaction history, your interests, preferences, feedback and survey responses.
• Usage Data and Log Data: includes details of your use of the App or any Service, including but not limited to traffic data and other communication data; the resources that you access; and information if there is an error in the App (including but not limited to your device Internet Protocol address, device name, operating system version, the configuration of the App when utilizing our App, the time and date of your use of the App, and other statistics).
• Marketing and Communications Data: includes your preferences in receiving direct marketing from us and third parties and your communication preferences.

If you do not wish to provide us with any personal data which is indicated as mandatory when we collect it (e.g. marked by an asterisk or similar on an online form), we may not be able to communicate with you or provide certain Services or features on the App to you.

We also collect, use and share aggregated data such as statistical or demographic data for any purpose. Aggregated data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific App feature. However, if we combine or connect aggregated data with your personal data so that it can be directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

If you intend to provide us with details of any other third party, you must give a copy of this privacy policy to, and obtain consent from, that third party before giving their personal data to us.

How is Your Personal Data Collected?

• Information you give us – This is information (including name, contact number and email address) you give us about you by filling in forms on the App, or by corresponding with us (for example, by email or chat). It includes information you provide when you register to use the App, download or register for the App, subscribe to any Service, or search for an App or Service, and when you report a problem with the App or any Service.
• Information we collect about you and your device – Each time you use the App, we will automatically collect personal data including device data and usage data as described above. We collect this data using cookies and other similar technologies.

  • To communicate with you about your use of the App and Services, inform you about the App and Services and any changes to the App or Services, and to respond to your inquiries, including but not limited to allowing us to make direct contact with you to follow up on reported incidents.
  • To monitor your use of the App and Services, in order for us to better understand your preferences and manage your relationship with us, to tailor the content and information that we may send or display to you, to provide personalized help and instructions, and otherwise to personalize your experiences while using the App and Services.
• Site and Services Improvement/Research and Operation:
  • To better understand how users access and use the App and Services, both on an aggregated and individualized basis.
  • To administer surveys and questionnaires, such as for market and user research or user satisfaction purposes.
  • To confirm, update and improve our records to maintain an accurate database.
  • To facilitate our business operations, and to operate company policies and procedures.
• Legal Purposes:
  • To comply with legal obligations, as part of our general business operations, and for other business administration purposes.
  • Where we believe necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person or violations of this privacy policy or other terms or agreements you have entered into with us.
• Marketing: To send marketing communications, in accordance with applicable law and with your consent, about: (1) newsletters and updates about us and our activities, projects, services and events; and (2) products and services of our affiliated organizations or organizations we believe you may be interested in. You can unsubscribe from these at any time by contacting us (see “Contact Us” below) or using the unsubscribe function on the direct marketing communication.

Disclosures of Your Personal Data

We may provide your personal data to our suppliers, agents and third party service providers, as well as our professional advisors, who provide administrative, technology, analytics, professional, and/or advisory services to Faith in Love in connection with our operations, whether inside or outside of Hong Kong SAR. We do this in order to fulfil the purposes described in this privacy policy (or directly related purposes), to facilitate and provide the App and/or Services, to assist with analysis of use of our App or to run our business operations. We put in place reasonable measures to procure that such persons do not disclose or use the data for any other purpose.

We may provide your personal data relating to incidents of discrimination that you report via the App or the Services to the following parties (whether within or outside Hong Kong): competent court of law, law enforcement agencies, Office of the Communications Authority, Equal Opportunities Commission or other governmental, statutory or regulatory authorities, institutions organizations, legal professionals, social workers, mediators or arbitrators. We will only do that with your consent. We do this to fulfil any of the purposes described in this privacy policy or for directly related purposes, including without limitation to perform the tasks assigned to them on our behalf. We put in place reasonable measures to procure that such persons do not disclose or use the data for any other purpose.

We may also disclose your personal data to comply with the law, or with a court order or other legal proceedings or process of any court, law enforcement, governmental and regulatory bodies in any applicable jurisdiction when required to do so.

We may also share your personal data with potential acquirers and their professional advisors in connection with potential or actual corporate restructuring or activity in connection with our organization.

We may disclose your personal data when we believe it is appropriate to do so to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our agreements or this privacy policy, or as evidence in litigation in which we are involved.

We may share aggregate, anonymized, or de-identified information about users with third parties for marketing, research or similar purposes.

International Transfers

In certain cases, your personal data may be shared, transferred or stored in jurisdictions outside of Hong Kong SAR. We may do this where we are satisfied that adequate levels of protection are in place to protect the integrity and security of your personal data and/or adequate security measures are adopted, in compliance with applicable data protection laws.

Security

All information you provide to us is stored on secured servers. Where we have given you (or where you have chosen) a password that enables to access certain parts of the App, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Once we have received your information, we will use procedures and security features to try to prevent your personal data from being accidentally lost, used or accessed in an unauthorized way. While we take all reasonable steps to protect your personal data, we cannot guarantee that it will be 100% secure, nor that any data breach will not occur.
